High Court ruling: Casa extension demolition order to be reviewed

The High Court has ruled in favour of a Brighouse Hotel, who was ordered to knock down their extension, for the decision to reviewed.

The Casa Hotel and Restaurant on Elland Road was ordered by the Planning Inspectorate that it must take down its three storey extension after losing its planning against Calderdale Council.

However, Castelite Limited, Casa’s parent company, appeared in the High Court to challenge the decision and was successful in getting the verdict reviewed.

A Calderdale Council spokesperson said: “Having considered legal arguments, the High Court has referred the appeals against refusal of planning permission and the enforcement notice back to the Planning Inspectorate for reconsideration.

“The Council is therefore expecting that there will be new public inquiry later this year, unless the Secretary of State successfully appeals against the High Court’s decision.”

The Planning Inspector Ahsan Ghafoor ruled in favour of the council in September 2015 and gave the owners nine months to take down the extension.

Bosses at Casa Hotel and Restaurant in Elland Road, Brighouse, extended the premises by constructing a three-storey function suite which the company claimed would generate around 38 full-time and 50 part-time well paid jobs.
